Report No. 23_Conclusion of the Agreement on Further Implementation of the Jaworzno project

Management Board of Mostostal Warszawa S.A. (“Company”), with reference to current reports 56/2019, 60/2019, 64/2019, 5/2020, 6/2020, 9/2020 and 13/2020, informs that 4 May 2020 the Company obtained the following information concerning the agreement for the construction of a 910 MW power unit (the 'Unit') for supercritical parameters in Jaworzno III Power Plant - Power Plant II - with respect to the steam boiler, turbine set, main building, electrical part and Control and Measurement Instruments and Automation Unit ( “Agreement”):

 

1. Rafako S.A. ("Rafako" or the "Leader") being the leader of the consortium (99.99% stake in the consortium) in which the Company is a partner (0.01% stake in the consortium) (“Consortium”) provided the Company with information that the Leader, E003B7 sp. z o.o. - a subsidiary of the Issuer ("SPV") and Tauron Wytwarzanie S.A. (“Employer”), (collectively referred to as the "Parties"), on 4 May 2020 concluded a cooperation agreement to continue work together in order to diagnose the causes and remedy the damage to certain components of the Block's boiler and work towards the release of the Block to the Employer. Pursuant to the Arrangement, each Party is committed to sharing its knowledge, experience and know-how in order to achieve the most effective resolution of the Incident.

 

2. The Parties agreed in the Arrangement to, among others, determine the scope of necessary and previously unforeseen additional work and agreed to agree to amend the Contract within 30 days of the Arrangement to include such work in the Contract as an annex.

 

3. The Parties have also agreed to resume work on the Block without delay in order to ensure the efficiency of the project and to maximise acceleration of activities. The Block is currently expected to be completed on 15 November 2020.
