The Management Board of Mostostal Warszawa S.A. (the "Company"), with reference to current report No. 6/2018 of 26 January 2018, informs that today the Company has become aware of the issuance by the Court of Appeal in Gdańsk of a judgment dismissing the appeal filed by Energa Kogeneracja Sp. z o.o. ("Respondent") concerning the judgement of the Regional Court in Gdańsk, 9th Commercial Division, dated 9 May 2022, adjudging from the Respondent to the Company the amount of PLN 26,274 thousand on account of payment for construction works together with statutory interest from the date of filing the statement of claim to the date of payment, which as at 15 January 2024 amounts to PLN 12 758 thousand and costs of litigation in connection with the performance of the contract entitled: 'Construction of a 20 MWe biomass-fired power unit at ENERGA Kogeneracja Sp. z o.o.'.

In connection with the disputes conducted with the Respondent, the Company recognised an asset in the amount of PLN 33 652 thousand in the financial books.
