Report 19/2025 - Finalization of the Court of Appeal's judgment in the case brought by Mostostal Warszawa SA against the Waste Disposal Plant Ltd. in Szczecin

The Management Board of Mostostal Warszawa SA ("Company"), referring to current report No. 20/2016 dated June 14, 2016, informs that today the Appeal Court in Szczecin approved the enforcement title in the case brought by Mostostal Warszawa SA against Zakład Unieszkodliwiania Odpadów sp. z o.o. in Szczecin ("ZUO"), regarding point I. of the judgment of the District Court in Szczecin dated December 22, 2023 (case file No. VIII GC 654/22), under which it awarded the Company an amount of PLN 33.77 million together with statutory interest for delay calculated until the payment date.

The dispute concerned the return to the Company of amounts from an unjustly executed performance bond for the contract No. ZUO/5/2012 for the construction of the Thermal Waste Disposal Plant for the Szczecin Metropolitan Area ("Contract"), from which the Company withdrew on June 14, 2016.

The Company informed about the progress of the proceedings, among others, in the current reports 20/2016, 31/2016, 3/2018, 20/2018, 61/2018, 2/2019, and 4/2019.

Due to the dispute with ZUO, the Company assumed that the claimed amount would be recovered and therefore recognized assets in the financial statements for previous years covering the majority of the amount sought.
